TikTok Contest Rules and Terms & Conditions
1. Introduction
1.1 Contest Overview: The TikTok Contest ("Contest") is a promotional activity organized by Cat Amazing (CA), a brand under Pet Amazing LLC. This Contest involves the creation and submission of cat videos featuring at least one CA puzzle toy, with submissions accepted via the following CA website form (https://catamazing.com/pages/tiktok-contest-upload-form). This Contest takes place from the first to the last day of each month.
1.2 Organizer's Details: The Contest is run by Pet Amazing LLC, a U.S. based company whose principal place of business is at 2200 North Central Rd., Fort Lee, NJ 07024 , under its brand, Cat Amazing. Cat Amazing creates innovative puzzle toys for cats that provide mental stimulation and engagement. Our puzzle toys cater to cats of all ages and breeds, delivering a rewarding and enriching experience.
1.3 Acceptance of Terms and Conditions: By entering the Contest, participants confirm their acceptance of these Terms and Conditions. Participation in the Contest is conditional upon acceptance and compliance with these Terms and Conditions. Entry instructions form part of these Terms and Conditions.
2. Eligibility Criteria
2.1 Residency: This Contest is open to legal residents of the United States with the exclusion of the following States: Arizona, Connecticut, Colorado, Illinois, Maryland, Nebraska, New Mexico, North Dakota, and South Dakota. By entering the Contest, participants confirm that they are a resident in the United States (with specific states excluded). If a participant is unable to prove their residency, they will be disqualified from the Contest.
2.2 Age Requirement: Participants must be at least eighteen (18) years of age at the time of entry. Proof of age may be required to verify eligibility. If a participant is found to be under the age of eighteen (18), their entry will be deemed invalid, and they will be disqualified from the contest.
2.3 Affiliation Restrictions: Employees of Pet Amazing LLC, their families, agents, or any third party directly associated with administration of the Contest are not eligible to participate. Cat Amazing reserves the right to verify the eligibility of participants and may require such information as it considers reasonably necessary for this purpose.
3. Contest Period
3.1 Contest Duration: The Contest will be held from the first to the last day of each month. The Contest Period may be extended or shortened by CA at its discretion. Any changes in the Contest Period will be communicated to contests via email and other relevant communication platforms used by CA.
3.2 Submission Deadline: The deadline for submission of entries is the last day of each month. Submissions received after the last day of each month will not be considered for that month's contest but may be considered for the following month's contest. Pet Amazing reserves the right to feature any video that was submitted at any given time for a future contest month.
3.3 View Calculation Date: The views of each video submission will be counted on the 15th day after the end of the Contest Period. This day will also serve as the judgment day for determining the winners based on view count.
3.4 Winner Announcement: The winners of the Contest will be announced via CA's social media platforms and/or newsletter after the view calculation date. Winners will also be contacted directly via email.
4. Contest Entry
4.1 Submission Process: Participants may enter the contest by uploading their videos via the designated form on the CA website (https://catamazing.com/pages/tiktok-contest-upload-form).
4.2 Video Requirements: Submitted videos must conform to the specified requirements. These include a maximum file size of 100MB with no restrictions on length. Each video must feature at least one CA product to be considered valid.
4.3 Submission Limit: Participant can submit multiple videos in a given month. Each video, however, must be unique and distinct from any other submissions by the same participant.
4.4 Submission Validation: CA reserves the right to validate each submission and to disqualify any entries that do not comply with the requirements or violate the terms and conditions of the contest.
4.5 Contest Entry Period: Entries can be submitted from the first day to the last day of each month. Any submissions made outside this period will not be considered for that month’s contest.
5. Video Content and Creative Freedom
5.1 Creative Freedom: Participants have full creative freedom in their video content, provided it adheres to the guidelines stipulated in these terms and conditions, as well as any relevant platform rules and regulations.
5.2 Video Description: Providing a video description is not mandatory but is greatly appreciated. Participants are encouraged to add descriptions to their videos that are relevant and align with the spirit of the contest.
5.3 Themes/Categories: The CA TikTok Contest does not specify themes or categories for the videos. All videos that meet the contest’s requirements are eligible for consideration.
5.4 Reposting Videos: A video posted to the CA TikTok is only eligible to participate in the contest once. CA reserves the right to repost any video for promotional purposes, although such reposted videos are not eligible for contest consideration.
5.5 Compliance: All video content must comply with the Community Guidelines of TikTok and any other relevant regulations. Any content found to be in violation of these rules may be disqualified.
6. Selection Process and Winner Determination
6.1 Selection Process: The selection of videos for the CA TikTok Contest will be determined solely by CA. CA reserves the right to not post any submission for any reason. The selection criteria are discretionary and may not follow fixed guidelines.
6.2 Winner Determination: The contest winners will be determined based on the view count of the featured videos. The count will take place on the 15th day after the end of the contest period. The three videos with the highest view counts will be deemed the winners.
6.3 Tie-Breaking Process: In the event of a tie, or similar view counts, the prize may be divided equally among the winners. The process for this division will be determined by CA.
6.4 Winners Announcement: Winners will be announced via CA's social media channels and newsletter. In addition, winners will be contacted directly via the email they provided during submission.
6.5 Decision Finality: All decisions by CA concerning selection and winners are final and binding. Participants agree not to dispute or challenge the results.
7. Prizes
7.1 Description of Prizes: The CA TikTok Contest offers a monthly cash prizes totalling $1000 ("Prize"). The Prize will be awarded to the winners of the contest as determined by the procedures outlined in these Terms and Conditions.
7.2 Division Among Winners: In case of a tie or similar view counts, CA reserves the right to divide the Prize among the winners. The distribution process will be determined solely by CA.
7.3 Prize Fulfillment: The Prize will be distributed to the winners via a method to be determined by CA. The preferred method is PayPal. Winners will be contacted via email for further information necessary for prize distribution.
7.4 Taxes and Fees: Any taxes, fees, or charges associated with the receipt or use of the Prize are the sole responsibility of the winner.
7.5 Non-Transferable: The Prize is non-transferable and may not be exchanged for any other prize or cash equivalent.
7.6 Right to Substitute Prize: CA reserves the right to substitute the Prize (or a portion thereof) with a prize of equal or greater value if the Prize is unavailable for any reason.
8. Intellectual Property Rights
8.1 Grant of Commercial License: Each participant acknowledges and agrees that upon entering the CA TikTok Contest:
(a) While participants retain all copyright and other intellectual property rights to their submitted video content, they grant CA an irrevocable, worldwide, royalty-free, perpetual license to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish, and otherwise commercially exploit the submitted video in any and all media, whether now known or hereinafter created.
(b) This license ensures that CA can utilize the video content for any purpose, commercial or otherwise, without further permission, notice, or compensation to the participant.
(c) Participants understand that even if their video is not selected as a winner, CA still retains the rights outlined in this section.
8.2 Copyright Acknowledgment: Participants acknowledge and confirm that they own the copyrights to the content they submit. By submitting the video, participants grant CA the right to use, reproduce, display, perform, adapt, modify, distribute, have distributed, and promote the content in any form, anywhere and for any purpose.
8.3 Reposting Restrictions: Participants are encouraged to use the official reposting feature on TikTok to share videos related to the contest. However, they are not allowed to publish the video by uploading the original of these videos on their personal accounts. Once a video is posted on the CA TikTok account, it is eligible to participate in the contest only once.
8.4 Non-Eligible Content: CA reserves the right to repost any video, even those that are no longer eligible for the contest. Reposting a video does not reinstate its eligibility.
8.5 Breach of Copyright: In the event that a participant infringes on someone else's copyright, the participant will be solely responsible for any damages or legal action arising from the infringement. CA disclaims any responsibility for copyright infringements made by participants.
9. Crediting and Promotion
9.1 Crediting: Each participant understands and agrees that if their video is selected to be featured on CA's social media platforms, CA may provide credit to the participant. This can be done by tagging the participant’s account and providing necessary attribution in the caption or comments of the post. This way the participant will receives recognition for the content they created.
9.2 Reposting: Participants are encouraged to utilize the official reposting feature on TikTok to share any of their videos that CA has selected and posted on its official account. Participants should refrain from directly posting/uploading these videos on their personal TikTok accounts. It should be noted that a video posted to CA's TikTok is only eligible to participate in the contest once. However, CA reserves the right to repost any video, even though it may not be eligible for the contest anymore.
9.3 Winner Announcement: CA will announce the winners of the contest on its official social media platforms as well as through the CA newsletter. Winners will also be contacted directly via the email address they provided during submission.
By participating in the contest, you consent to CA's use of your name, likeness, and submission for promotional purposes, including but not limited to publicizing the winners, without further compensation, unless prohibited by law. Participants agree to the use of their names and/or likeness for advertising and publicity purposes, without additional compensation, as decided by CA.
10. Personal Data and Privacy
10.1 Data Collection: For the purposes of contest administration, CA will collect personal data from participants, which includes but may not be limited to name, email address, and TikTok username. This information is gathered via the contest entry form on the CA website.
10.2 Data Usage: The personal data collected will be used exclusively for the administration of the contest. This includes selecting and contacting winners, promoting the contest and its results, as well as for potential future communication related to CA products and initiatives.
10.3 Data Protection: CA is committed to maintaining the confidentiality, integrity, and security of the personal data provided by the participants. Appropriate security measures will be in place to prevent unauthorized access, modification, disclosure, or loss of the collected data.
10.4 Winner Contact: Winners will be contacted via the email address they provided during the contest submission process. If the winner does not respond within a reasonable timeframe as set by CA (30 days), or cannot accept the prize for whatever reason, the prize may be forfeited and an alternate winner may be selected.
10.5 Consent: By entering this contest, all participants consent to the collection, use, and disclosure of their personal data for the purposes described in this section. Participants acknowledge and agree that they are providing their personal information voluntarily and understand that their data will be processed in accordance with these terms and conditions.

11. Disclaimers and Liability
11.1 Contest Operations: CA shall not be held responsible for any errors, omissions, interruptions, deletions, defects, or delays in the operation or transmission of any information pertaining to the contest, including but not limited to, the CA website, submissions, or any direct or indirect losses that may occur from the aforementioned issues.
11.2 Technical Issues: CA disclaims all liability for any malfunction of any internet connection, computer equipment, software, or any combination thereof, which may prevent the participant from entering or continuing the contest.
11.3 Inability to Participate: CA is not responsible for any inability of a potential participant to correctly visit the site, participate in the contest, or download any information in relation to the contest, including the submission form and terms and conditions document.
11.4 Damage Claims: Participants agree that CA (and its employees, agents, representatives, or affiliated companies) will not be responsible for any damages or losses of any kind, including direct, indirect, incidental, consequential, or punitive damages arising out of participant’s access to and use of the CA website, or the downloading from and/or printing material downloaded from the website.
11.5 Participant Liability: By participating, each participant agrees to indemnify, release, and hold harmless CA, its respective parents, affiliates, subsidiaries, advertising and promotion agencies, and other individuals engaged in the development or execution of this contest, from any and all liability for any injuries, loss, or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize, participation in this contest, or while traveling to, preparing for, or participating in any prize-related activity.
11.6 Force Majeure: CA shall not be liable for any failure of the contest if such failure arises from an event of Force Majeure, such as natural disasters, Acts of God, strikes, or other occurrences beyond the control of CA.
This section is not intended to limit any statutory rights as a consumer that may not be excluded under applicable law, including the right to seek a remedy in case of non-performance or inadequate performance by CA of any of its obligations related to the contest.
12. Changes and Termination
12.1 Changes: CA reserves the right, at its sole discretion, to modify, suspend, or terminate the contest or any portion thereof, including without limitation, the contest rules and regulations, at any time, for any reason with or without notice. Such changes, if made, will be effective immediately upon posting, and your continued participation in the contest after such changes have been posted constitutes participant's acceptance of those changes.
12.2 Termination: CA reserves the right to suspend, cancel, or terminate the contest at any time for any reason, including but not limited to, situations where CA cannot run the contest as planned for reasons beyond its control, such as tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of CA that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest.
12.3 Notice: Any changes, suspension, or termination of the contest will be notified to participants via the CA website, social media channels, or the CA newsletter. It is the responsibility of the participants to stay informed about any changes.
12.4 No Liability: In case of suspension, cancellation, modification, or termination of the contest, CA shall not be liable to any participant or any other person for anything associated with the early termination of the contest.
12.5 Survival: Provisions of these terms that, by their nature, should survive termination of these terms shall so survive. This includes but is not limited to, Intellectual Property Rights, Disclaimers and Liability, and Dispute Resolution sections.
13. Dispute Resolution
13.1 Agreement to Arbitrate: By participating in the contest, you agree that any dispute, claim, or controversy arising out of or relating to the contest or these Terms and Conditions, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by individual arbitration in the state of [insert state] or another location mutually agreeable to the parties.
13.2 Governing Law: All disputes will be governed by and construed in accordance with the laws of the United States and the State of Delaware without regard to its conflicts of law principles.
13.3 Procedure: A demand for arbitration must be in writing and delivered by certified mail or overnight courier to Pet Amazing LLC at its registered office. The arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the American Arbitration Association.
13.4 Decisions: Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessment of costs, expenses, and reasonable attorneys' fees.
13.5 Binding Arbitration: You understand and agree that the arbitration shall be binding and can be entered as a judgment in any court of competent jurisdiction.
13.6 No Class Actions: You agree that you may bring claims against us only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Unless both you and CA agree, no arbitrator or judge may consolidate more than one person’s claims or otherwise preside over any form of a representative or class proceeding.
14. Final Provisions
14.1 Social Media Platforms: This contest is in no way sponsored, endorsed, administered by, or associated with TikTok, or any other social media platform used in connection with the contest. All trademarks, service marks, trade names, trade dress, product names and logos appearing in relation to this contest are the property of their respective owners, including in some instances TikTok. Any rights not expressly granted herein are reserved.
14.2 Severability: If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms and Conditions will continue in full force and effect.
14.3 Entire Agreement: These Terms and Conditions and any documents expressly referred to in them constitute the entire agreement between you and CA with respect to the Contest, and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the Contest.
14.4 No Waiver: No failure or delay by CA in exercising any right, power or privilege under these Terms and Conditions will operate as a waiver thereof, nor will any single or partial exercise of any right, power or privilege preclude any other or further exercise thereof or the exercise of any other such right, power, or privilege.
14.5 Language: These Terms and Conditions are in English and all communications and notices to be given pursuant to these Terms and Conditions shall be in English.
15. Acknowledgment
15.1 Acceptance of Terms: By participating in the CA TikTok Contest, you hereby affirm that you have thoroughly read, understood, and agree to abide by these Terms and Conditions in their entirety.
15.2 Understanding of Terms: You acknowledge that you fully comprehend the meaning and implications of each provision included in these Terms and Conditions. If there are any terms that you do not understand, it is your responsibility to seek clarification before participating in the contest.
15.3 Voluntary Agreement: You further affirm that your agreement to these Terms and Conditions is voluntary and has not been influenced by any promises, representations, guarantees, or warranties not contained herein.
15.4 Changes in Terms: You understand and agree that Pet Amazing LLC reserves the right to amend these Terms and Conditions at any time. By continuing to participate in the contest after any such changes, you signify your consent to the updated Terms and Conditions.
15.5 Affirmation: Your submission of content to the CA TikTok Contest constitutes your express acknowledgment and acceptance of these Terms and Conditions.
